1. About pay3.so

Welcome to pay3.so ("pay3", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of pay3.so and related services (collectively, the "Service").

By accessing or using pay3.so, you agree to be bound by these Terms. If you don't agree to these Terms, do not use our Service.

1.1 What We Do

  • Custom payment profiles (pay3.so/@username)
  • Payment link generation
  • Wallet address management
  • Payment routing information

1.2 What We Don't Do

Important: pay3.so is a non-custodial service. We:

  • Never hold, custody, or control your cryptocurrency
  • Never access your private keys or wallet credentials
  • Do not process or execute transactions on your behalf
  • Are not a money transmitter, payment processor, or financial institution

All cryptocurrency transactions occur directly between sender and receiver wallets. We simply provide the interface and routing information.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to use pay3.so. By using our Service, you represent that you meet this age requirement.

2.2 Legal Compliance

You must comply with all applicable laws in your jurisdiction, including:

  • Tax reporting obligations
  • Securities regulations
  • Anti-money laundering (AML) laws
  • Know Your Customer (KYC) requirements (where applicable)

2.3 Prohibited Jurisdictions

Our Service may not be available in all countries. You are responsible for ensuring that your use of pay3.so complies with local laws.

3. Account Registration

3.1 Account Creation

To use pay3.so, you must:

  • Create an account using either a valid email address or Telegram account
  • Choose a unique username
  • Provide accurate information
  • Maintain the security of your account credentials

When signing up with Google/Telegram, you authorize us to access your Google/Telegram account information for authentication purposes only.

3.2 Username Policy

  • Usernames must be 3-20 characters (4-20 for Free tier)
  • First-come, first-served basis
  • Must not infringe trademarks or impersonate others
  • Must not contain offensive or prohibited content
  • We reserve the right to reclaim usernames that violate these Terms

3.3 Account Security

  • Maintaining confidential access to your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong passwords and enabling two-factor authentication when available

4. Service Plans and Pricing

4.1 Pricing Tiers

pay3.so offers multiple subscription tiers: Free, Pro, Creator, Business and Enterprise. For current pricing and features, please visit our pricing page.

4.2 Subscription Terms

  • Subscriptions are billed monthly or annually as selected
  • All fees are non-refundable except as required by law
  • We may change pricing with 7 days' notice to existing subscribers
  • Annual subscriptions lock in pricing for 12 months
  • Subscriptions auto-renew unless cancelled

4.3 Free Tier Limitations

  • Limited custom payment links
  • Limited wallet addresses
  • Username length restrictions (4-20 characters)
  • No verification badge

4.4 Cancellation

  • You may cancel your subscription at any time
  • Access continues until the end of the current billing period
  • Upon cancellation, your account reverts to the Free tier
  • Data is retained per our Privacy Policy

5. Using pay3.so

5.1 Wallet Addresses

You are responsible for:

  • Providing accurate wallet addresses
  • Ensuring addresses support the tokens you've selected
  • Testing addresses with small amounts first
  • Understanding that incorrect addresses may result in lost funds

We are not liable for funds sent to incorrect addresses.

5.2 Payment Links

When creating payment links, you agree to:

  • Provide accurate payment amounts and descriptions
  • Not use links for illegal purposes
  • Not mislead payment senders
  • Respect applicable regulations (securities laws, etc.)

5.3 Accepted Use

You may use pay3.so for:

  • Personal payments between friends
  • Freelance work compensation
  • Selling goods or services
  • Receiving donations or tips
  • Splitting bills or group expenses
  • Any other lawful purpose

5.4 Prohibited Use

  • Illegal activities or prohibited goods/services
  • Money laundering or terrorist financing
  • Fraud, scams, or deceptive practices
  • Securities offerings without proper registration
  • Gambling or games of chance (where prohibited)
  • Adult content or services
  • Infringing intellectual property rights
  • Harassment, hate speech, or harmful content
  • Activities that violate export controls or sanctions

6. Network Fees and Transactions

6.1 Transaction Fees

pay3.so charges zero transaction fees for transactions. All peer-to-peer payments are direct between wallets.

6.2 Network Fees

  • Blockchain network fees (gas fees) are paid by the sender
  • Network fees vary by blockchain and network congestion
  • We display estimated fees but cannot control actual costs
  • Fees are paid to blockchain validators, not to pay3.so

6.3 Transaction Completion

  • We do not guarantee transaction completion
  • Transactions may fail due to network issues, insufficient funds, or incorrect addresses
  • You are responsible for monitoring transaction status on the blockchain
  • We are not liable for failed, delayed, or reversed transactions

7. Intellectual Property

7.1 Our Content

The pay3.so platform, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you provide (profile information, payment descriptions, etc.). By using our Service, you grant us a license to use this content to operate and improve pay3.so.

7.3 Trademarks

"pay3" and our logo are trademarks. You may not use our trademarks without written permission.

8. Third-Party Services

8.1 Wallet Integrations

pay3.so integrates with third-party wallet services (Trust Wallet, MetaMask, exchange apps, etc.). Your use of these services is subject to their own terms and privacy policies.

8.2 Blockchain Networks

We support multiple blockchain networks. We are not responsible for network downtime or failures, smart contract vulnerabilities, protocol changes or hard forks, or network congestion or fee spikes.

9. Disclaimers and Limitations

9.1 Service Availability

  • We provide the Service "as is" without warranties
  • We do not guarantee uninterrupted or error-free operation
  • We may modify, suspend, or discontinue features at any time
  • Scheduled maintenance may cause temporary unavailability

9.2 Financial Disclaimer

  • pay3.so is not a financial advisor
  • We provide no investment, tax, or legal advice
  • Cryptocurrency is volatile and you may lose value
  • You are responsible for your own financial decisions

9.3 No Liability for Lost Funds

  • Funds sent to incorrect addresses
  • Private key loss or theft
  • Wallet hacks or exploits
  • Smart contract bugs
  • Exchange or platform failures
  • User error or negligence

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAY3.SO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US (FOR SUBSCRIPTION) IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless pay3.so and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your violation of any laws or regulations, or your violation of third-party rights.

11. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Termination

12.1 Termination by You

You may close your account at any time by contacting support.

12.2 Termination by Us

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account is inactive for extended periods (7+ months). Username will be automatically released and will be made available for other users.
  • Required by law or regulation
  • We discontinue the Service

12.3 Effect of Termination

  • Your payment links will be deactivated
  • Your public profile will be removed
  • Subscription fees are non-refundable
  • We may retain certain data per our Privacy Policy
  • You remain liable for activities before termination

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Gurugram, India, without regard to conflict of law principles.

13.2 Arbitration Agreement

Any disputes arising from these Terms or your use of pay3.so shall be resolved through binding arbitration, except where prohibited by law.

13.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

14. Changes to Terms

14.1 Modifications

We may update these Terms at any time. We will notify you of material changes via email notification, in-app notification, or notice on our website.

14.2 Continued Use

Your continued use of pay3.so after changes constitutes acceptance of the new Terms. If you disagree with changes, you must stop using the Service.

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and pay3.so regarding the Service.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

15.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
